首先我们需要了解“律师”这个词在英语中的不同称谓。我们最常见的英文为lawyer。除了lawyer之外，英文中常用的具有“律师”含义的词还有attorney，solicitor，barrister， advocate，counsel， counsellor，bar等。这些词在西方不同的国家使用习惯和含义有所不同。

Attorney，代理人、法律事务代理人、律师。这个词是指接受当事人委托，并有资格在法庭上代理当事人出庭参与诉讼的律师。比lawyer更正规、更书面，与委托人（client）相对应。这个词较广泛的应用于美国，还有更正式的可以称为attorney-at-law或者counselor at law。

在英国和香港有两类执业律师，称为Solicitor和Barrister。Solicitor为初级律师，事务律师，香港常称为沙律师，主要处理非诉讼业务和一些在初级法院出庭的诉讼业务，起草法律文件，出具法律意见，提供法律咨询等。一般只能在基层法院代理当事人出庭发表意见，但是，如果事务律师满足一定的执业条件和年限，经过考核也可以申请在高级法院出庭。

Barrister为出庭律师，香港也称为巴律师，大律师，港台影视剧中常称为“大状”，他们准许在高级法院出庭辩护或者代理。Barrister执业超过10年且表现优异，可申请成为资深大律师，以前也称为御用大律师（Queen'sCounsel）。出庭的时候Barrister需要戴假发，而Solicitor不戴假发。

出庭律师（Barrister）通常不能直接为当事人所聘请，如果需要，通常由当事人的事务律师（Solicitor）代表当事人聘请。出庭律师更注重口才和思辨能力，而事务律师更注重文书写作能力，两者的区别只是职业分工的不同，并不代表等级的不同。从事出庭律师，还是事务律师完全看个人的兴趣爱好和执业方向。

Lawyer比较强调职业（profession），干这行的，受过训练可以提供法律咨询/意见的都叫lawyer

Attorney强调被委任(appointment)，被授权可以代表委托人行事的叫attorney

Counselor强调律师工作的咨询/顾问方面（counseling），和lawyer差不多，但是不用来指职业（很多职业都有counselor）。

Barrister是出庭律师，在法庭上帮人辩护，相对的就是

Solicitor，主要是向委托人获取信息，准备文件，很少出庭；要出庭也大多只是在初级法院

Attorney 是律师被客户雇佣后的一种称呼。Attorney本身有代理人的含义，也就是说客户授权律师代表自己，为自己处理相应的法律问题。

Counselor 是指代理律师中上法庭辩护的那个律师。一个人可以有一群Attorney，但是其中只能有一个是Counselor。Counselor是唯一能在法庭上为客户进行辩护的人，一般无特殊原因，Counselor是不能随便更换的。最常说Counselor这个词的人就是法官大人了，在很多美剧中，你都会看到双方律师在法庭上吵得不可开交，而这时法官大人就会生气地说：Counselors，come to my bench!（律师们，到我的席前来一下！
